Terms of Use

These terms cover What Days Work?, an iPhone app and iMessage extension published by BogeyApps. Using the app means you accept them.
If you do not accept them, do not use the app. What the app does with your information is a separate document: the privacy policy.
Zero tolerance for objectionable content and abusive behaviour
There is no tolerance for objectionable content or abusive users in What Days Work?. Content that is obscene, hateful, harassing, violent, sexually explicit, illegal, or that targets or degrades a person or a group, is not allowed anywhere in the app — in a plan's name, in the name you go by, in a note you leave against a date, or in the second question a plan asks and the options it offers.
Anything in the app can be reported from where you see it, using Report this plan on the plan's own menu. Reports are reviewed within 24 hours. Objectionable content is removed, and a plan whose content breaks these terms is deleted outright, which removes it for everybody in it.
You can also report by writing to support@bogeyapps.com with the plan's six-character code. Whoever created a plan can call it off at any time, which deletes it and every answer on it immediately and does not wait for us.
There is no account
The app does not ask you to sign in, and there is nothing for you to keep secret except the codes of the plans you are in. A plan's code is what opens it: anyone you give it to can see the plan and add themselves to it, so share it with the group you meant to ask and not more widely.
What you write
You keep ownership of what you type. By typing it into a plan you accept that everybody else in that plan will see it, and you confirm that it is yours to share and that it does not break the paragraph above.
Use a name people in the plan will recognise. Do not impersonate anybody, and do not answer on somebody else's behalf without their say-so.
Acceptable use
- Do not use a plan, its name or its notes to send anybody a message they have not asked for.
- Do not try to guess codes, or open plans you were not given the code to.
- Do not attempt to break, overload or work around the app or its service, or to read or change anybody else's answer.
- Do not republish what you can see in a plan somewhere else without the say-so of the people in it.
We may remove a plan, or block access to the service, where these terms are broken.
The dates are what people typed
What the app works out is arithmetic over the days people marked. It cannot know whether somebody marked them accurately, whether they changed their mind and did not say, or whether the person who has not answered can come. Check with the people who matter before you book anything.
Availability
The app is provided as it is. Creating, answering and refreshing a plan need a network, and the service behind them may be unavailable or may change. A plan that is called off is deleted and cannot be recovered.
No warranty, and the limit of our liability
To the fullest extent the law allows, What Days Work? is provided without warranties of any kind, express or implied, including fitness for a particular purpose and uninterrupted or error-free operation. To the fullest extent the law allows, BogeyApps is not liable for indirect or consequential loss, or for a plan, an answer or a booking, arising out of your use of the app. Nothing here limits liability that cannot be limited by law, and you may have rights under consumer law that these terms do not affect.
Apple
Apple is not a party to these terms and has no responsibility for the app or its content. Except where these terms say otherwise, Apple's standard licensed application end user licence agreement also applies, and these terms prevail where the two disagree.
Changes to these terms
These terms may be updated. The date at the top says when they last were. Continuing to use the app after a change means accepting it.
Governing law
These terms are governed by the laws of the State of Michigan, United States, without regard to its conflict-of-laws rules, and the courts of that state are where a dispute about them is heard.
If you live somewhere whose consumer protection law gives you rights you cannot sign away, this does not take them from you, and you may bring a claim in the place you live.
