These terms cover Bogey Golf Pro, an iPhone, iPad and Apple Watch app published by BogeyApps. Using the app means you accept them.
Bogey Golf Pro is the app formerly listed as BogeyGolf. If you do not accept these terms, do not use the app. What the app does with your information is a separate document: the privacy policy.
There is no tolerance for objectionable content or abusive users in Bogey Golf Pro. Content that is obscene, hateful, harassing, violent, sexually explicit, illegal, or that targets or degrades a person or a group, is not allowed anywhere in the app — in a photograph, a caption, a credit, a profile, a player name or an event name.
Every photograph submitted for publication is reviewed before it can reach anybody's screen. Anything in the app can be reported from where you see it, and any golfer can be blocked from your contact card. Reports are reviewed promptly, and objectionable content is removed and the account responsible ejected.
You can report content or behaviour from inside the app, or by writing to support@bogeyapps.com. Blocking somebody is immediate and does not wait for us; blocks can be undone under Settings → Blocked golfers.
An account belongs to one person and is identified by an email address you control. Keep access to that address, since it is how you sign in — there is no password to recover. Do not share an account, impersonate anybody, or create an account on somebody else's behalf without their knowledge.
You may delete your account at any time under Settings → Account. We may suspend or delete an account that breaks these terms.
You keep ownership of what you write and photograph. By submitting a photograph for publication in the app you confirm that:
We may decline or remove any submission for any reason, and we are not obliged to publish anything.
A shared round is a card several people write on. Do not enter scores you know to be false for somebody else, and do not use a shared card, an event name or an invitation to send anybody a message they have not asked for. What you can see about another golfer is what they have chosen to share; do not republish it elsewhere without their say-so.
Distances are computed from your phone's GPS and from mapped course geometry, both of which can be wrong or out of date; every distance is to the middle of the green, never to the flag as cut today. A handicap index the app calculates is an estimate for your own use and is not an official handicap issued by a golf authority. Bogey Golf Pro is not affiliated with, and is not an authority on, the Rules of Golf. Use your own judgement on the course, and pay attention to where you are walking and driving rather than to your phone.
The app is provided as it is. Features that need a network — shared rounds, invitations, course search, notifications — depend on services that may be unavailable or may change, and a shared scorecard is deleted after 60 days without anyone opening it. Keep your own backup of anything you would mind losing; the app can export one.
To the fullest extent the law allows, Bogey Golf Pro is provided without warranties of any kind, express or implied, including fitness for a particular purpose and uninterrupted or error-free operation. To the fullest extent the law allows, BogeyApps is not liable for indirect or consequential loss, or for lost scores, statistics or data, arising out of your use of the app. Nothing here limits liability that cannot be limited by law, and you may have rights under consumer law that these terms do not affect.
Apple is not a party to these terms and has no responsibility for the app or its content. Except where these terms say otherwise, Apple's standard licensed application end user licence agreement also applies, and these terms prevail where the two disagree.
These terms may be updated. The date at the top says when they last were, and a change that matters is described in the app's release notes. Continuing to use the app after a change means accepting it.
These terms are governed by the laws of the State of Michigan, United States, without regard to its conflict-of-laws rules, and the courts of that state are where a dispute about them is heard. Where a course is, or where you played it, does not change that — this clause is about the terms, not about your golf.
If you live somewhere whose consumer protection law gives you rights you cannot sign away, this does not take them from you, and you may bring a claim in the place you live.
